("us," "we," or "our") operates websites, including https://www.rsmbiz.com, Retail Sports Marketing mobile applications, and/or other online services (collectively, the "Services"). This Privacy Policy informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Services and the choices you have associated with that data. For the purposes of many privacy laws, we are the data controller of your personal data. Our contact information is found at the end of this Privacy Policy if you have any questions or concerns about this Privacy Policy. This Privacy Policy does not apply where we collect and otherwise process personal data as a processor/service provider on behalf of our customers who are the controllers of your personal data.

This Privacy also does not apply to third-party websites, products, or services, even if our Site links to them or vice versa. We recommend that you review the privacy practices of those third parties before sharing personal data with them.

We may use Simple Analytics, Google Analytics, or other service providers for analytics services. These analytics services may use cookies to help us analyze how users use the Services. Information generated by these services (e.g., your IP address and other usage information) may be transmitted to and stored by Simple Analytics, Google Analytics, and other service providers on servers in the United States (or elsewhere) and these service providers may use this information for purposes such as evaluating your use of the Services, compiling statistic reports on the Services’ activity, and providing other services relating to Services activity and other Internet usage.  

Third-Party Ad Networks

Certain companies may participate in the Digital Advertising Alliance ("DAA") AdChoices Program and may display an Advertising Option Icon for Interest-based Ads that links to an opt-out tool which allows you to exercise certain choices regarding targeting. In addition, certain advertising networks and exchanges may participate in the Network Advertising Initiative (“NAI”). NAI has developed a tool that allows consumers to opt out of certain Interest-based Ads delivered by NAI members' ad networks. Please be aware that, even if you can opt out of certain kinds of Interest-based Ads, you will continue to receive non-targeted ads. Retention of Data

Retail Sports Marketing Inc. will retain your personal data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain personal data such as usage data for internal analysis purposes. This information is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer time periods.  

Our determination of precise retention periods will be based on (i) the length of time we have an ongoing relationship with you; (ii) whether there is a legal obligation to which we are subject; and (iii) whether retention is advisable in light of our legal position, including regard to applicable statutes of limitations, litigation or regulatory investigations.

Your Rights Under State Law

California

  • Shine the Light law. Pursuant to California Civil Code Section 1798.83, we will not disclose or share your Personal Information with third parties for the purposes of third-party marketing to you without your prior consent.
  • Do Not Track Signals.  Other than as disclosed in this Policy, the Services do not operate any differently when it receives Do Not Track signals from your internet web browser.
  • WE DO NOT SELL OR SHARE YOUR PERSONAL INFORMATION. If we ever decide to “sell” or “share” Personal Information, as those terms are defined under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, we will update you via this Policy and include a link entitled “Do Not Sell or Share My Personal Information,” to provide you with an opportunity to opt out of the selling or sharing of your Personal Information.

Nevada

Nevada law permits customers in Nevada to opt-out of the sale of certain kinds of Personal Information. We do not sell your Personal Information to third parties as defined in Nevada law. To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the Personal Information. In some instances, such as a request to delete personal information, we may first separately confirm that you would like for us to in fact delete your personal information before acting on your request.

We will respond to your request within forty-five (45) days. If we require more time, we will inform you of the reason and extension period in writing. You may have the right to appeal our decision regarding your request. If you would like to appeal our decision, please contact us using the contact information provided above.

In some cases our ability to uphold these rights for you may depend upon our obligations to process Personal Information for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, or because processing is necessary to deliver the services you have requested.
